1. General provisions
1.1. This document is a public offer (Article 437 of the Civil Code of the Russian Federation) by Intellectual Medical Technologies LLC (OOO «IMT», OGRN 1269600002770, INN 6679188579, KPP 667901001, address: 620024, Sverdlovsk Region, Yekaterinburg, Bisertskaya St., 16, bldg 1, account 40702810520000282747 with OOO «Bank Tochka», Moscow, BIC 044525104, corr. account 30101810745374525104, represented by General Director Tatiana Anistratova acting under the Charter; the Provider) to conclude an agreement on the terms set out below with any legally capable individual aged 18 or over (the User).
1.2. The agreement is concluded by accepting the offer. Acceptance is registering an account: entering an email address and the one-time code sent to it after reading this offer (Article 438(3) of the Civil Code). The agreement is concluded at the moment of acceptance and remains in force until terminated under Section 9.
1.3. The parties’ relations are governed by the Civil Code, Law No. 2300-1 of 7 February 1992 “On consumer protection” (the Consumer Protection Law), Federal Law No. 149-FZ of 27 July 2006 “On information, information technologies and information protection”, Federal Law No. 63-FZ of 6 April 2011 “On electronic signatures” and Federal Law No. 54-FZ of 22 May 2003 “On the use of cash register equipment”. Terms that diminish consumer rights compared with the law do not apply (Article 16 of the Consumer Protection Law).
1.4. The Provider’s email for enquiries: privacy@healthrating.net. Operating hours: around the clock; enquiries are answered on working days.
2. Subject of the agreement
2.1. The Provider gives the User access to the Platform: the website healthrating.net, the account area my.healthrating.net and the HemoTrack app, and provides the information services listed in Section 3.
2.2. Services are provided remotely, over the Internet, in electronic form. The result of a service is displayed in the User’s account.
2.3. The Provider is not a medical organisation and does not provide medical care. Interpretation of readings consists of comparing a value with the reference interval of the laboratory that issued the report and showing the trend; it is for reference, contains no diagnoses, risk assessments or prescriptions, and does not replace a doctor’s consultation. The Platform’s software is not a medical device. Check-ups under the state programme are free under the OMS policy at the medical organisation the user is registered with.
3. Services and prices
3.1. Free and without time limit: the account, the “What’s covered under OMS” calendar, the home readings diary, storage of lab reports, community membership, the level and privileges under the Loyalty programme rules.
3.2. Interpretation of test readings. Until plans are published, interpretation is free. Plans, if introduced, are published on the Pricing page and in the account no later than 10 days before they take effect; the price is the same for all Users. Services provided before plans take effect are not payable.
3.3. A vitamin is a 100 percent discount on the interpretation of one reading. How vitamins are obtained is set out in the Loyalty programme rules. A vitamin is not money or a means of payment and cannot be exchanged for money.
3.4. Prices are in roubles and include all taxes. The full price of a service is shown before it is ordered.
4. Payment and refunds
4.1. Paid services are paid for in the account by bank card or another method available through the Provider’s payment provider. The User may choose any of the offered payment methods (Article 16.1 of the Consumer Protection Law). A receipt is sent to the User’s email address (Federal Law No. 54-FZ).
4.2. A service is deemed provided when the interpretation result becomes available in the account.
4.3. The User may cancel a service before it is provided (Article 32 of the Consumer Protection Law). The amount paid is refunded by the same method within 10 days of receiving the request (Article 31). If a service is provided with a defect (the result was not delivered or contains an error attributable to the Provider), the User may demand that the defect be remedied free of charge or that the amount paid be refunded (Article 29).
4.4. Payment and refund requests are sent to privacy@healthrating.net or through the account.
5. Electronic interaction and simple electronic signature
5.1. The parties agree that documents and messages sent through the account or to the email address given at registration are legally significant (Article 165.1 of the Civil Code). The User must maintain access to their email address and update it in the account settings if it changes.
5.2. This Section is an agreement on the use of a simple electronic signature (Article 6(2) and Article 9 of Federal Law No. 63-FZ). The key of the User’s simple electronic signature is the one-time code sent to their email address combined with access to the account. The signatory is identified by the email address of the account in which the code was entered and by the Provider’s log with the date, time, IP address and session identifier.
5.3. An electronic document (consent, application, acceptance of rules, service order) created in the account after the code is entered and confirmed by pressing the corresponding button is deemed signed with the User’s simple electronic signature and equivalent to a paper document signed by hand.
5.4. The User must keep the key confidential: not pass codes or access to their email and devices to third parties, and, if compromise is suspected, end all sessions in the account (“log out everywhere”) and inform the Provider. For sensitive actions (changing consents, exporting and deleting data, family access) the Provider requests a repeated code.
5.5. The Provider keeps the signing log for the term of the agreement and three years after its termination and provides the User with copies of documents they signed on request.
6. Account
6.1. One User keeps one account. Children’s profiles are managed in the legal representative’s account; an adult relative’s profile is managed only with that person’s own consent.
6.2. The User is responsible for actions performed in their account using their simple electronic signature key unless they prove that access was obtained by third parties through no fault of theirs and that they informed the Provider in time.
6.3. The Provider may suspend access to the account on detecting actions that breach the law or this offer (in particular, uploading forged reports, attempts at unauthorised access, actions that disrupt the Platform), notifying the User by email with the reason. The User may submit objections within 10 days; access is restored if the breach is not confirmed. The User’s reports, readings and other data are not deleted during suspension and remain available for export.
7. Personal data
Personal data is processed under the Personal data processing policy. Health data is processed only on the basis of the User’s separate written consent signed with a simple electronic signature under Section 5; declining such consent does not prevent use of the Platform’s other functions.
8. Liability
8.1. The parties are liable in accordance with the law of the Russian Federation. The Provider’s liability to a consumer User is determined by the Consumer Protection Law and is not limited by this offer.
8.2. The Provider keeps the Platform operational and gives at least 24 hours’ notice of planned interruptions in the account. Interruptions caused by force majeure or by third-party actions beyond the Provider’s control are not a breach of the agreement.
8.3. The Platform’s reference information is not medical advice; the User makes health decisions independently and together with a doctor. The Provider is not responsible for the content of reports received from laboratories or for the services of loyalty programme partners.
9. Term, amendment and termination
9.1. The agreement is open-ended. The User may terminate it at any time by deleting the account in the settings; personal data is destroyed under the Personal data processing policy.
9.2. The Provider may amend the offer by publishing a new edition in the Documents section and notifying Users in the account no later than 30 days before the amendments take effect. Amendments do not apply to services ordered and paid for before they take effect. A User who disagrees with the amendments may terminate the agreement before they take effect.
9.3. The Provider may terminate the agreement only on the grounds provided by law.
10. Disputes
10.1. Enquiries and claims are sent to privacy@healthrating.net and handled within 10 days (Article 31 of the Consumer Protection Law). Pre-trial settlement is not mandatory.
10.2. Disputes are resolved under the law of the Russian Federation. A consumer User may bring a claim before a court of their choice in accordance with Article 17 of the Consumer Protection Law.
